HIPAA Notice of Privacy Practices

Effective Date: May 29, 2026 · This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Who We Are

Divine Agape Health Care Agency ("Divine Agape") is a licensed home care organization located at 300 E Esplanade Drive, Suite 1720, Oxnard, CA 93036. As a provider of home care services that coordinates with Medi-Cal Managed Care Plans and other healthcare entities, we are committed to maintaining the privacy of your protected health information (PHI) in accordance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and applicable California law.

How We May Use and Disclose Your Health Information

Treatment

We may use or disclose your PHI to coordinate and provide the home care services outlined in your care plan, and to communicate with other healthcare providers involved in your care — including your physician, Medi-Cal Managed Care Plan, hospitals, and skilled nursing facilities.

Payment

We may use or disclose your PHI to bill and collect payment for services we provide, including submitting claims to your Medi-Cal Managed Care Plan and processing Treatment Authorization Requests (TARs).

Healthcare Operations

We may use or disclose your PHI for our internal operations, including quality improvement, staff training, compliance activities, and business management functions necessary to operate our agency.

Other Permitted Disclosures

We may also use or disclose your PHI without your authorization when required or permitted by law, including:

• As required by federal, state, or local law
• For public health activities (e.g., reporting communicable diseases)
• To report suspected abuse, neglect, or domestic violence to authorized authorities
• For health oversight activities by government agencies
• In response to a court order or legal process
• To law enforcement officials under specific circumstances
• To avert a serious threat to health or safety
• For workers' compensation purposes

Uses and Disclosures Requiring Your Authorization

All other uses and disclosures of your PHI not described in this notice — including most uses for marketing purposes, sale of PHI, and uses of psychotherapy notes — require your written authorization. You may revoke any such authorization at any time in writing.

Your Rights Regarding Your Health Information

Right to Access Your PHI

You have the right to inspect and obtain a copy of your health information maintained in our records. Requests must be submitted in writing. We may charge a reasonable fee for copies.

Right to Request Amendment

If you believe information in your record is incorrect or incomplete, you may request that we amend it. We may deny your request under certain circumstances.

Right to an Accounting of Disclosures

You have the right to request a list of certain disclosures we have made of your PHI in the past six years.

Right to Request Restrictions

You may request restrictions on how we use or disclose your PHI for treatment, payment, or healthcare operations. We are not required to agree to all requested restrictions, but we will accommodate reasonable requests when possible.

Right to Confidential Communications

You may request that we communicate with you about your health information in a specific way or at a specific location (e.g., only by phone or only at a certain address).

Right to a Paper Copy of This Notice

You have the right to receive a paper copy of this Notice of Privacy Practices at any time, even if you have agreed to receive it electronically.

Our Duties

Divine Agape is required by law to:

• Maintain the privacy of your PHI
• Provide you with this notice of our legal duties and privacy practices
• Follow the terms of the notice currently in effect
• Notify you if there is a breach of your unsecured PHI

We reserve the right to change this notice and make the new notice effective for all PHI we currently maintain. Updated notices will be posted at our office and on our website.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights. You will not be retaliated against for filing a complaint.
